TERMS & CONDITIONS (MEMBERSHIP AGREEMENT)

These Terms govern your access to and use of ourhiddenearth.com and the Hidden Earth membership (the “Service”). By creating an account, starting a trial, or purchasing a plan, you agree to these Terms.

1. What we provide

Hidden Earth is a subscription service that gives members access to curated travel content, including a map of “hidden gems,” images, descriptions, links to third-party mapping apps and other resources (the “Content”).

We may update, add, or remove features or Content at any time to improve the Service.

2. Eligibility & accounts

You must be at least 16 years old to use the Service.
Keep your login details confidential; you’re responsible for all activity on your account.
We may suspend or terminate accounts that violate these Terms.

3. Plans, trials, billing & renewals

Prices are shown in USD and billed in USD unless stated otherwise. Bank conversion fees (if any) are charged by your provider.
If you start a free trial, access lasts for the period shown at signup. At the end of the trial, your plan auto-renewsat the then-current price unless you cancel before renewal.
Auto-renewal: Monthly, 6-month, and 12-month plans renew automatically until cancelled in your account settings.
Changes to pricing: We may change prices with prior notice. Changes apply to the next renewal.
Taxes: Where applicable, VAT or similar taxes may be added at checkout.

4. Cancellations & refunds

Cancel anytime: You can cancel future renewals at any time from your account settings; access continues until the end of the current paid term.
Money-back guarantee: If you’re not happy within 14 days of your first paid membership payment, contact us at [info@ourhiddenearth.com] for a full refund. (Guarantee applies once per customer and excludes subsequent renewals unless required by law.)
Trial periods are free; no refunds apply to expired trials.
We may deny or revoke refunds in cases of abuse, fraud, or excessive use during the guarantee window.

5. Acceptable use

You agree not to:

Copy, scrape, bulk-download, or create a database from the Content or map locations.
Share, resell, sublicense, or publicly post member-only Content.
Circumvent access controls or use automated tools without permission.
Upload or contribute anything unlawful, infringing, or harmful.

We may monitor abuse and limit access (e.g., rate limits) to protect the Service.

6. Safety & responsibility at locations

Hidden Earth provides information only. We do not own or manage any locations. Visiting any location is at your own risk and subject to local laws and access rules. You are responsible for:

Checking current conditions (closures, permits, weather, tides, safety).
Respecting private property, conservation rules, and local communities.
Your personal safety and the safety of anyone travelling with you.

7. Third-party services

The Service may link to third-party sites and apps (e.g., Google/Apple Maps, social media, booking sites). We are not responsible for those services, their content, or their terms and privacy practices.

8. Intellectual property

All Content, software, branding and materials on the Service are owned by or licensed to Hidden Earth and protected by IP laws.
We grant you a personal, limited, non-exclusive, non-transferable license to access and use the Service for your own trip planning while your membership is active.
You may not reproduce, distribute, modify, or create derivative works from the Content without our written consent.

9. Your content & feedback

If you submit suggestions, reviews, photos, or location tips (“User Content”):

You retain ownership, but grant Hidden Earth a worldwide, royalty-free, sublicensable license to use, host, reproduce, modify, and display your User Content in connection with the Service and marketing.
You confirm you have the rights to share it and that it doesn’t infringe others’ rights.
We may moderate, edit, or remove User Content at our discretion.

10. Disclaimers

The Service and Content are provided “as is” and “as available.” We do not guarantee that:

every location is open, safe, accessible, or as described;
the Service will be uninterrupted or error-free; or
results will meet your expectations.

To the fullest extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, Hidden Earth and our directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption.

Our total liability for any claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited.

12. Indemnity

You agree to defend, indemnify, and hold Hidden Earth harmless from claims, damages, losses, and costs (including legal fees) arising from your misuse of the Service or violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or misuse the Service. Sections that by nature should survive termination (e.g., IP, disclaimers, liability limits) will survive.

14. Changes to the Service or Terms

We may modify the Service and these Terms. If changes are material, we’ll notify you (e.g., by email or in-product notice). Continued use after the effective date means you accept the updated Terms.

15. Governing law & disputes

These Terms are governed by the laws of England and Wales. Courts of England and Wales shall have exclusive jurisdiction, except you may also have rights to bring a claim in your country of residence under consumer law.
